1. Agreement to Terms

Welcome to Vidhi Varshiki ("Platform", "we", "our", or "us"). These Terms of Service ("Terms") govern your access to and use of our advocate case management platform, website, and related services.

By accessing or using our Platform, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the Platform.

Note: These Terms constitute a legally binding agreement between you and Vidhi Varshiki. Please read them carefully before using our services.

2. Eligibility & User Accounts

Eligibility

  • You must be at least 18 years of age
  • For lawyer accounts, you must be a licensed advocate enrolled with a recognized Bar Council
  • You must provide accurate and complete registration information
  • You must have the legal capacity to enter into a binding agreement

Account Responsibilities

  • Maintain the confidentiality of your account credentials
  • Notify us immediately of any unauthorized access
  • You are responsible for all activities under your account
  • Do not share your account with others

3. Description of Services

Vidhi Varshiki provides:

  • Case Management: Tools to manage cases, clients, and hearings
  • Hearing Reminders: Notifications for upcoming court dates
  • Lawyer Directory: Public listing of registered advocates
  • Legal Resources: Access to circulars, handbooks, and legal news
  • Expense Tracking: Financial management for legal practices

The Platform is a case management tool and does NOT provide legal advice. You remain solely responsible for your professional legal obligations.

4. Professional Responsibility

As a legal professional using our Platform, you agree to:

  • Comply with all applicable Bar Council rules and professional ethics
  • Maintain client confidentiality and attorney-client privilege
  • Not use the Platform for any illegal or unethical purposes
  • Ensure accuracy of information entered into the system
  • Not rely solely on the Platform for critical deadline management
  • Maintain independent backup systems for important data

5. Data Security & Risk Acknowledgment

IMPORTANT: While we implement industry-standard security measures, you acknowledge and accept the following risks:

  • No Absolute Security: No digital system is 100% secure against all threats
  • Cyber Attacks: Risk of unauthorized access through hacking or cyber attacks
  • Data Breaches: Possibility of data exposure despite security measures
  • System Failures: Technical failures may affect data availability
  • Third-Party Risks: Vulnerabilities in third-party services we use

By using this Platform, you accept these risks and agree not to store highly sensitive information without appropriate safeguards. We recommend maintaining offline backups of critical case data.

6. Prohibited Uses

You agree NOT to:

  • Use the Platform for any unlawful purpose
  • Impersonate any person or entity
  • Upload false or misleading information
  • Attempt to gain unauthorized access to other accounts
  • Interfere with or disrupt the Platform's security
  • Use automated systems to access the Platform without permission
  • Transmit viruses, malware, or harmful code
  • Violate any applicable laws or regulations
  • Harvest or collect user data without consent

7. Intellectual Property

The Platform, including its content, features, and functionality, is owned by Vidhi Varshiki and is protected by intellectual property laws.

  • You retain ownership of data you upload to the Platform
  • You grant us a license to use your data to provide services
  • You may not copy, modify, or distribute our Platform without permission
  • Trademarks and logos are property of their respective owners

8. Limitation of Liability

THE PLATFORM IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • We do not guarantee uninterrupted or error-free service
  • We are not liable for missed deadlines or hearing dates
  • We are not responsible for data loss or corruption
  • We are not liable for any indirect, incidental, or consequential damages
  • Our total liability shall not exceed the amount you paid for the service

You acknowledge that reminders are supplementary tools and should not be your sole method of tracking important dates.

9. Indemnification

You agree to indemnify and hold harmless Vidhi Varshiki, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:

  • Your use or misuse of the Platform
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Any content you upload or share through the Platform

10. Termination

We may terminate or suspend your account at any time for:

  • Violation of these Terms
  • Fraudulent or illegal activity
  • Non-payment of applicable fees
  • Extended period of inactivity

You may terminate your account at any time by contacting us. Upon termination, your right to use the Platform ceases immediately.

11. Governing Law & Dispute Resolution

These Terms shall be governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Lucknow, Uttar Pradesh.

Before initiating legal proceedings, parties agree to attempt good-faith negotiations to resolve disputes.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes via email or Platform notification. Continued use of the Platform after changes constitutes acceptance of the new Terms.
